1. Introduction

Welcome to Cruise Way ("Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Cruise Way website, mobile application, and all related services (collectively, the "Platform"), through which you may browse, compare, and book car rentals, flights, cruise packages, and other travel-related products offered by third-party suppliers ("Suppliers").

Binding Agreement: By accessing or using our Platform, making a booking, or clicking "I Agree," you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms in their entirety, you must not use the Platform or make any bookings through it.

Cruise Way acts as an intermediary and booking agent between you and the third-party Suppliers (airlines, car rental agencies, cruise lines, and other travel service providers). We do not own, operate, or control the travel services themselves. Your booking is subject to the applicable Supplier's own terms, conditions, and policies in addition to these Terms.

These Terms apply to all users of the Platform, including visitors, registered account holders, and anyone who makes a booking through Cruise Way. The terms operating for car rental, flights, and cruises may differ across service types; please carefully review the service-specific sections below.

2. Definitions

For the purposes of these Terms, the following definitions apply:

"Supplier"The third-party provider of travel services, including but not limited to car rental agencies (Enterprise, Hertz, Avis, Budget, National, Alamo, etc.), airlines (Delta, United, American, Air Canada, WestJet, Porter, etc.), and cruise lines (Royal Caribbean, Carnival, Norwegian, Disney, Celebrity, Princess, etc.).
"Traveler," "You," "Your"The individual using the Platform and/or named on a Booking, including any accompanying passengers, additional drivers, and guests.
"Fare" or "Rate"The base price of a travel service, exclusive of taxes, fees, surcharges, and optional add-ons unless otherwise stated.
"Total Price"The all-inclusive amount payable for a Booking, including the base fare, applicable taxes, Supplier-imposed fees, and Cruise Way service charges.
"Force Majeure Event"An event beyond the reasonable control of a party, as further defined in Section 12.

3. Eligibility & Accounts

3.1 Age Requirement

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to create an account and make a Booking through the Platform. For car rentals, the minimum rental age is typically 21 to 25 years, depending on the Supplier and location, and renters under 25 may be subject to an additional daily surcharge.

3.2 Account Registration

When creating an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account, refuse service, or cancel Bookings at our sole discretion if we suspect fraudulent, abusive, or unlawful activity, or if you violate these Terms.

3.3 Accurate Information

You are responsible for ensuring that all information provided during the booking process—including traveler names (matching government-issued identification exactly), contact details, payment information, passport numbers, driver's license details, and travel dates—is accurate and complete. Cruise Way is not liable for any issues arising from inaccurate, incomplete, or misleading information provided by you, including denied boarding, refused vehicle pickup, or denied cruise embarkation.

4. Car Rental Terms

This section applies specifically to car rental Bookings made through the Platform ("Rental Bookings"). All Rental Bookings are subject to both these Terms and the individual rental Supplier's terms and conditions, which you will be required to acknowledge at the time of vehicle pickup.

4.1 Driver Requirements

The license must be valid for the entire rental period. For renters whose license is not in English, an International Driving Permit (IDP) may be required.

Credit/Debit CardA major credit card in the renter's name is required at pickup. Some locations accept debit cards with additional verification. Prepaid cards, cash, and checks are not accepted for deposits.
Security DepositA refundable deposit (typically $300–$1,000) is held on the renter's credit card at pickup and released upon satisfactory vehicle return.

4.2 Additional Drivers

Additional drivers beyond the primary renter must appear at the rental counter with the primary renter, present a valid driver's license, and meet all age and qualification requirements. An additional daily fee (typically $10–$15 per day per additional driver) applies, unless the additional driver is the renter's spouse or domestic partner.

4.3 Cross-Border Travel

Vehicles rented in the United States may generally be driven throughout the US and Canada, subject to Supplier approval and notification at the time of booking. Vehicles rented in Canada may generally be driven throughout Canada and the US. Vehicles may not be driven into Mexico under any circumstances. Certain vehicle classes (exotic cars, large passenger or cargo vans, specialty vehicles) may have additional geographic restrictions. Cross-border travel may require advance written authorization and may incur additional daily charges.

4.4 Insurance & Protection Products

Car rental rates quoted on the Platform typically include basic liability coverage as required by law. The following optional protection products are offered at the rental counter:

  • Damage Waiver (DW): Also known as Collision Damage Waiver (CDW) or Loss Damage Waiver (LDW). This optional daily fee (typically $27–$50/day) waives or reduces the renter's financial responsibility for loss of or damage to the rental vehicle. DW is not insurance. Your personal auto insurance policy, credit card benefits, or other coverage sources may provide duplicate coverage.
  • Supplemental Liability Protection (SLP): Provides additional third-party liability coverage beyond the statutory minimum limits.
  • Personal Accident Insurance (PAI): Covers medical expenses for the renter and passengers in the event of an accident.
  • Personal Effects Coverage (PEC): Covers theft or damage to personal belongings in the rental vehicle.
  • Roadside Assistance: Optional protection for lockout services, jump starts, fuel delivery, flat tire assistance, and towing.
Important: The purchase of any protection product is optional and not required to rent a vehicle. We recommend that you review your existing insurance coverage, credit card protections, and other sources of coverage before purchasing optional products at the rental counter.

4.5 Fuel Policy

Most Suppliers operate a "full-to-full" fuel policy: you receive the vehicle with a full tank and must return it with a full tank to avoid refueling charges. Suppliers typically offer prepaid fuel purchase options at the time of rental, though no refund is issued for unused fuel.

4.6 Mileage Limits

Most standard rental vehicles come with unlimited mileage. However, certain vehicle categories, specialty rentals, short-term rentals, or rentals with out-of-province/state travel may be subject to mileage restrictions (e.g., 200 km per day or 3,000 km per month). Excess mileage charges will be disclosed in the rental agreement at the time of pickup.

4.7 Late Pickup Grace Period

Suppliers generally hold a vehicle for a limited grace period beyond the scheduled pickup time. Grace periods vary by Supplier: Hertz (29 minutes), Enterprise (30 minutes), Avis (59 minutes), Budget (29 minutes). If you are running late, contact the rental Supplier directly. Reservations not claimed within the grace period may be released, and the Booking may be treated as a no-show.

4.8 Early Return

Returning a vehicle earlier than the scheduled return date may result in your rental rate being recalculated to the applicable daily rate for the actual rental duration, which may be higher than the original rate. No refund is guaranteed for unused rental days on prepaid reservations.

5. Flight Booking Terms

This section applies specifically to flight Bookings made through the Platform ("Flight Bookings"). All Flight Bookings are subject to both these Terms and the operating airline's Conditions of Carriage, fare rules, and applicable tariffs.

5.1 Fare Types & Restrictions

5.2 24-Hour Risk-Free Cancellation

Under the U.S. Department of Transportation's 24-hour cancellation rule, most airlines allow passengers to cancel a booking within 24 hours of purchase and receive a full refund to the original form of payment, provided the reservation is made at least 7 days (or 48 hours, depending on the airline) before the scheduled departure. Some airlines also offer a 48-hour free cancellation and modification window for bookings from select regions.

5.3 Check-in & Boarding Requirements

  • Check-in Times (Domestic Flights): Passengers must be checked in at least 45–60 minutes before scheduled departure for the boarding pass to be issued. Checked baggage must be accepted by the airline at least 45 minutes before departure.
  • Check-in Times (International Flights): Passengers must be checked in at least 60–90 minutes before scheduled departure.
  • Boarding Gate Deadlines: Passengers must be at the departure gate at least 15–30 minutes before departure. Most airlines close boarding 10–15 minutes before departure time. Late-arriving passengers will be denied boarding and may forfeit the full fare.
  • Travel Documents: Passengers are solely responsible for possessing valid passports, visas, Electronic Travel Authorizations (eTAs for Canada), ESTA authorizations (for the US), health certificates, and all other required documentation for travel. Cruise Way is not responsible for denied boarding due to inadequate or expired travel documents.

5.4 Baggage Allowance

Baggage fees are airline-specific and subject to change. The baggage allowance for your specific Booking will be detailed in your booking confirmation and can also be verified on the operating airline's website. Passengers should confirm baggage policies prior to travel.

5.5 Schedule Changes & Flight Disruptions

In the event of a significant schedule change (generally defined as a change of 2+ hours to departure or arrival time, a change in routing, or a change from nonstop to connecting service), the operating airline is responsible for contacting affected passengers and offering rebooking options or refunds in accordance with its Conditions of Carriage and applicable law. Cruise Way will assist where possible but is not liable for airline-initiated schedule changes, delays, or cancellations. We strongly recommend that passengers monitor their flight status directly with the operating airline, especially within 72 hours of departure.

6. Cruise Booking Terms

This section applies specifically to cruise Bookings made through the Platform ("Cruise Bookings"). All Cruise Bookings are subject to both these Terms and the operating cruise line's Guest Ticket Contract, which is a binding legal agreement between you and the cruise line.

6.1 Cruise Fare Components

Cruise fares are per person based on double occupancy in US or Canadian dollars (as specified at booking) and include:

  • Included in Fare: Stateroom accommodations, standard meals in main dining venues, most onboard activities, entertainment, access to pools and fitness facilities, children's programs (where applicable), and port taxes and government fees (depending on cruise line).
  • Not Included in Fare (Typical): Airfare to/from the departure port (unless expressly included), shore excursions, specialty dining, alcoholic beverages, soda and bottled water, gratuities/service charges, spa services, internet/WiFi packages, travel insurance, passport/visa fees, onboard purchases, casino spending, medical services, and personal expenses. Gratuities are typically charged at a daily per-person rate (commonly $14.50–$20.00/day depending on cruise line and stateroom category).

Important: Reservations not paid in full by the final payment date are subject to automatic cancellation by the cruise line, and your deposit may be forfeited. Cruise Way will send payment reminders prior to the final payment due date where possible, but you are solely responsible for ensuring timely payment.

6.3 Required Travel Documents

It is the sole responsibility of each guest to obtain and carry all required travel documents, including:

  • Passport: Valid for at least 6 months beyond the final day of the cruise for all international itineraries. Some closed-loop cruises (departing from and returning to the same US port) may accept a government-issued birth certificate along with a government-issued photo ID for US citizens, but a passport is strongly recommended.
  • Visas: Certain destinations require visas for entry. Guests are responsible for verifying visa requirements for all ports of call on their itinerary.
  • Vaccination & Health Requirements: Cruise lines and destinations may require proof of specific vaccinations or health screenings. Requirements vary by itinerary, cruise line, and prevailing health regulations.
Denied Boarding: Guests who arrive at the cruise terminal without proper documentation will be denied boarding and will not be entitled to a refund. Cruise Way is not responsible for guests who are unable to travel due to inadequate documentation.

6.4 Onboard Conduct & Cruise Line Policies

All cruise guests are subject to the cruise line's onboard rules, policies, and Code of Conduct. Cruise lines reserve the right to disembark any guest whose behavior is deemed disruptive, dangerous, or in violation of cruise line policies, without refund or compensation. Minimum drinking age aboard most cruise ships is 21 years for itineraries that include US ports and 18 years for most international itineraries. Guests under 21 must travel with a guest who is 21 or older in the same or connecting stateroom (cruise-line-specific policies may vary). Infants must generally be at least 6 months old (12 months for transatlantic and certain other itineraries) at the time of sailing.

7. Payment & Pricing

7.1 Currency & Pricing

All prices displayed on the Platform are in US Dollars (USD) by default for US-originating Bookings and Canadian Dollars (CAD) for Canada-originating Bookings, unless otherwise stated. Prices are subject to change without notice until a Booking is confirmed. Fuel surcharges for cruises, airline-imposed surcharges, government taxes, airport fees, port charges, and other mandatory charges are generally included in the Total Price displayed at checkout but may be itemized separately depending on the service.

7.2 Price Guarantee

Once your Booking is confirmed and full payment is received, the Total Price is guaranteed. Any subsequent increases in Supplier-imposed charges, taxes, or fees will not be passed on to you unless otherwise stated. For cruise bookings, cruise lines reserve the right to impose fuel surcharges in the event of significant fuel price increases.

7.3 Accepted Payment Methods

7.4 Service Fees

Cruise Way may charge a Booking Fee or Service Fee for each reservation made through the Platform. This fee is clearly displayed at checkout prior to payment. The fee varies based on the type and complexity of the travel service. This fee is non-refundable once a Booking is confirmed unless cancellation is initiated by the Supplier or otherwise required by applicable law.

7.5 Incorrect Pricing & Errors

In the event of an obvious pricing error (also known as a "fat finger" error), the price displayed for a travel service is materially incorrect, or any material information in the Platform is erroneous, Cruise Way reserves the right to cancel the Booking and provide a full refund. You will be notified of any such error as soon as reasonably practicable.

8. Cancellation & Refunds

Cancellation policies vary significantly by Supplier, location, rate type (flexible vs. prepaid), and season. The specific cancellation terms for your Booking will be clearly displayed at checkout and confirmed in your booking voucher. Flexible "pay-later" reservations are typically cancellable right up to the scheduled pickup time with no charge.

8.2 Flight Cancellation Policy

Flight cancellation policies depend on the fare type and airline. Basic Economy fares are generally non-refundable and non-changeable after the 24-hour risk-free cancellation window. Main Cabin and higher fares on Delta, United, American, and Air Canada do not carry a standard change fee for flights originating from the US, Canada, and the Caribbean. When a new itinerary costs more, the fare difference is charged. Refundable fares may be cancelled at any time for a full refund to the original form of payment. Nonrefundable fares are typically returned as eCredit rather than cash.

Specific cancellation schedules vary by cruise line, voyage length, promotional terms, and booking date. The exact cancellation terms applicable to your cruise will be clearly displayed during the booking process. Cruise line cancellation policies apply to the entire booking—partial cancellations (e.g., cancelling one guest in a double-occupancy room) will result in the remaining guest being charged the applicable single-supplement rate. Changes to departure dates may be treated as cancellations by the cruise line and cancellation penalties may apply. Cruise line Future Cruise Credits (FCCs) are issued at the sole discretion of the cruise line, subject to expiration and usage restrictions. Cruise Way does not guarantee the availability, value, or transferability of FCCs.

8.4 General Refund Policy

Refunds, when applicable, will be processed to the original form of payment within 7–14 business days following cancellation confirmation. However, the actual time for the funds to appear in your account may be longer depending on your financial institution's processing times (international banks may take up to 30–45 days for credit card deposit releases). Any Cruise Way service fees are non-refundable once a Booking has been confirmed, unless the cancellation is initiated by the Supplier. Third-party extras (travel insurance, airport transfers, prepaid activities) may have separate cancellation policies as outlined in the booking details.

9. Booking Changes & Modifications

9.1 Changes Prior to Travel

Booking changes (date modifications, vehicle type changes, itinerary or flight time adjustments, route changes, passenger name corrections, destination or port modifications) are subject to availability, applicable Supplier change fees, and any fare/rate difference. Name changes on flight tickets are generally not permitted; most airlines treat a name change as a cancellation and rebooking, with applicable fees and fare differences. For cruises, changes to the lead passenger name or all passenger names on a reservation may be treated as a cancellation. Change fees, when applicable, are charged in addition to any fare/rate differences between the original and new itinerary. For flights, most major US and Canadian carriers have eliminated change fees on Main Cabin and higher fares. Change requests must be submitted through the Platform or directed to the operating Supplier.

9.2 Same-Day Flight Changes

Many airlines offer same-day confirmed changes or same-day standby for a reduced fee (typically $50–$75) for Standard Economy and above fares. Basic Economy fares are not eligible for same-day changes. Same-day change availability depends on seat availability on alternative flights and must be requested directly with the airline.

9.3 Cruise Stateroom Upgrades

Cruise lines may offer stateroom upgrade programs (e.g., Royal Caribbean's RoyalUp, Norwegian's Upgrade Advantage, Celebrity's MoveUp). Upgrade bid programs allow booked guests to bid on higher-category staterooms. Upgrade bids are accepted at the cruise line's sole discretion. Upgrade bid acceptance may be within days or even hours of sailing. If an upgrade bid is accepted, the original stateroom is released and cannot be recovered.

10. Liability & Disclaimers

10.1 Cruise Way's Role as Intermediary

IMPORTANT: Cruise Way acts solely as a booking agent and intermediary between you and the third-party Suppliers (airlines, car rental agencies, cruise lines, and other travel service providers). We do not operate, control, or provide the underlying travel services. As such, we are not liable for the acts, omissions, errors, representations, warranties, breaches, or negligence of any Supplier, nor for any personal injury, death, property damage, delay, inconvenience, or other loss or damage resulting from your use of the travel services booked through the Platform.

Any claims, disputes, or issues arising from the performance or non-performance of a travel service must be resolved directly with the Supplier. This includes, but is not limited to, claims related to flight delays, cancellations, denied boarding, lost or damaged baggage, vehicle defects or mechanical failures, cruise itinerary changes, overbooking, Supplier bankruptcy, or refusal of service.

10.2 Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, Cruise Way disclaims all warranties, express or implied, including but not limited to:

  • That the Platform will be uninterrupted, error-free, secure, or free of viruses or harmful components;
  • That the information, content, or materials on the Platform are accurate, complete, reliable, or current;
  • The availability, quality, safety, or legality of the travel services offered by Suppliers;
  • That Supplier-provided pricing, availability, or descriptions will remain unchanged after your Booking is confirmed.

10.3 Limitation of Liability

To the maximum extent permitted by applicable law, Cruise Way, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of use, loss of goodwill, or cost of substitute services, arising out of or in connection with your use of the Platform or any Booking made through it, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and regardless of whether Cruise Way has been advised of the possibility of such damages.

In no event shall Cruise Way's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the total amount of the Booking Fee and Service Fee paid by you to Cruise Way for the specific Booking giving rise to the claim. The foregoing limitation of liability reflects the allocation of risk between the parties and is an essential element of the basis of the bargain between you and Cruise Way.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our gross negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by applicable law.

12. Force Majeure

Neither Cruise Way nor any Supplier shall be liable or responsible for any failure to perform, or delay in performance of, any obligations under these Terms or any Booking that is caused by a Force Majeure Event. A "Force Majeure Event" means any act, event, omission, or circumstance beyond the reasonable control of the affected party, including but not limited to:

  • Strikes, lockouts, or other industrial action;
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or undeclared) or threat of war;
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster;
  • Impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transport;
  • Interruption or failure of utility service (including telecommunications and Internet);
  • Acts of any government or governmental authority, including travel bans, border closures, and port closures;
  • Any other event that the affected party could not reasonably have anticipated or controlled.
Note on Supplier Policies: In the event of a Force Majeure Event, cancellations and refunds will be governed by the applicable Supplier's force majeure and cancellation policies. Cruise Way will make reasonable efforts to assist you in coordinating with Suppliers for cancellations, rebookings, and refunds during Force Majeure Events.

13. Disputes & Governing Law

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law principles, for Bookings originating in the United States. For Bookings originating in Canada, these Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

13.2 Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or any Booking made through the Platform shall be resolved in the following manner:

  1. Informal Resolution: You agree to first contact Cruise Way at legal@Cruise Way.com and attempt to resolve the dispute informally. Both parties agree to negotiate in good faith for a period of at least 30 days before initiating any formal proceeding.
  2. Binding Arbitration: If the dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (for US claims) or by the ADR Institute of Canada (ADRIC) under its Arbitration Rules (for Canadian claims). The arbitration shall be conducted on an individual basis; class actions, class arbitrations, and representative actions are expressly prohibited.
  3. Exceptions: Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent immediate or irreparable harm, including claims related to intellectual property infringement or unauthorized use of the Platform.

YOU AND Cruise Way AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

13.3 Time Limitation

Any claim or cause of action you may have arising out of or relating to these Terms or your use of the Platform must be commenced within one (1) year after the claim or cause of action accrues, or it shall be permanently barred, to the fullest extent permitted by applicable law.
